When understaffing contributes to a grocery store slip-and-fall

When visitors fall at a grocery store or similar business, they may have grounds for a premises liability lawsuit. Those hurt due to unsafe property conditions may have a right to request compensation for their injuries and property damage expenses.

Typically, those pursuing financial compensation after getting hurt at a place of business need proof of negligence. Understaffing in the retail sector, especially at grocery stores, has been an ongoing issue as of late. The combination of low wages and demanding work conditions makes it difficult for grocery stores and similar retail establishments to maintain adequate staff levels.

Combine that with business practices that prioritize minimizing costs above all else, and that is a recipe for unsafe conditions. If injured visitors can show that understaffing contributed to an incident that left them hurt, they may be in a position to take action against the business where they fell.

Understaffing leaves safety issues unattended

When there aren’t enough workers on hand to manage every job responsibility, workers have to prioritize certain tasks above others. Typically, running the registers and providing customer service are the top priorities.

Cleaning and facility maintenance may have to wait until the end of a shift when the store finally closes. If there aren’t enough workers on hand to readily attend to spills and similar issues, then customers could end up injured because someone else dropped a jar of salsa or spilled the coffee in the middle of the produce section.

Companies that make their facilities available to the public need to have enough workers on hand to not only manage the customers on the premises but also to keep the facilities relatively clean. If there were only two employees and dozens of customers in the store, a reasonable person could recognize that workers are not in a position to keep the store clean while still meeting the needs of those visitors.

In scenarios where corporate policies end up putting customers at risk, people who get hurt as a result may have grounds for a premises liability lawsuit. Establishing that a company was negligent is often the first step toward holding that business accountable for creating an unsafe environment via a premises liability lawsuit.
